Wayne Kuskopf OCR269-19

On 1 August 2019 the applicant Wayne Kuskopf filed with the Queensland Civil and Administrative Tribunal (the Tribunal), an application to review the Queensland Racing Integrity Commission (the Commission) internal review decision 0048-19 of 4 July 2019. 

The Tribunal, on 28 October 2019, invited the Commission, pursuant to s23(1) of the Queensland Civil and Administrative Tribunal Act 2009 (Qld) (the Act), to reconsider the decision subject to review. 

On 29 October 2019, the Commission, in accordance with s23(2) of the Act, reconsidered the internal review decision resulting in the following decision:

  1. The applicant is guilty of breaching Australian Rule of Racing 178 and the penalty is amended from a $4000 fine to a to a $4000 fine with $2000 wholly suspended for a period of two (2) years providing the applicant does not reoffend under Australian Rule of Racing rule 240(2) (formerly ARR rule 178) during the suspension period.
